Repeat DUI Offenders Now Face Jail in Colorado
Colorado governor Bill Ritter signed legislation this week that now requires jail time for those who are repeatedly caught for driving under the influence.
The new law requires a ten day minimum in jail for a second offense and 60 days for a third offense. Sixty days is the sentence for DUIs past the third. Work-release programs are available, but not an in-home detention for those who get a second offense within five years of the first.
While there is still no felony law for people who are repeat offenders in Colorado, they are required to be on probation for two years and to enter alcohol-rehabilitation and treatment programs.
The new law has been a long time coming in Colorado, but gained steam after the Denver Post did a series of stories last year about repeat offenders receiving no jail time after their seventh DUI offense. The stories in the Post also found that sentences differed from county to county, and that some offenders never received jail time, even after killing people in drunken driving accidents.
Now, Governor Ritter says the judge has to put you in jail if you receive a third DUI.
