Memorial Day

Wanted to thank all of our Veterans for the sacrifices they have made for our country. Our country is great because of the efforts made to preserve our freedoms and our way of life.

Repeat DUI Offenders Now Face Jail in Colorado

Colorado governor Bill Ritter signed legislation this week that now requires jail time for those who are repeatedly caught for driving under the influence.

The new law requires a ten day minimum in jail for a second offense and 60 days for a third offense. Sixty days is the sentence for DUIs past the third. Work-release programs are available, but not an in-home detention for those who get a second offense within five years of the first.

While there is still no felony law for people who are repeat offenders in Colorado, they are required to be on probation for two years and to enter alcohol-rehabilitation and treatment programs.

The new law has been a long time coming in Colorado, but gained steam after the Denver Post did a series of stories last year about repeat offenders receiving no jail time after their seventh DUI offense. The stories in the Post also found that sentences differed from county to county, and that some offenders never received jail time, even after killing people in drunken driving accidents.

Now, Governor Ritter says the judge has to put you in jail if you receive a third DUI.

Port Orange Firefighter Allegedly Stole Pain Medication

A veteran Port Orange firefighter has been charged with scheme to defraud, grand theft and burglary of a residence. He is suspected of lying his way into at least four homes to steal the residents' pain medication.

In one incident, the firefighter allegedly told the girlfriend of a man who had recently died that the fire department had special receptacles to dispose of narcotics. She then handed him two large garbage bags containing mostly pain medication.

The firefighter also allegedly went to another home twice claiming that he was looking for missing tools. The woman who lived there found that her husband's pain medication was missing after the second visit.

The fourth case alleges that the firefighter overheard some of his fellow firefighters discussing a patient that was most likely on pain medication. The firefighter then allegedly went to the patient's home and stole medication from there.

Five investigators went to the firefighter's home, armed with a search warrant, where they allegedly found over 12,000 pills belonging to other people. They also allegedly found garbage bags containing bloody syringes, used needles, gauze, a latex band used to tie arms for injections, and incident reports from the fire department.

The firefighter asked others to lie for him, and now investigators are wondering if he stole from other homes.

He was released on $50,000 bail.

Delaware Man Indicted on 20 Counts for Faking College Degrees

A 23-year-old Delaware man has been charged with identity fraud, larceny and falsifying documents from Massachusetts Institute of Technology, Harvard University, Phillips Academy, and other schools.

Allegedly, the accused submitted applications for the Rhodes Scholarship and the Fulbright Scholarship while he was a senior at Harvard in 2009. Within the application were several recommendations from Harvard professors, his college transcript which showed perfect grades for three years, a project statement, and a resume listing books he had allegedly co-authored, lectures he had given, and courses he had taught.

A Harvard professor who reviewed the application noticed similarities between the application of the accused and another Harvard professor. Upon investigating further, it was found that the accused had allegedly plagiarized virtually the entire application. After this, it was found that he had falsified documents when applying to Harvard, including recommendations, transcripts, and essays and test results from MIT and the Phillips Academy of Andover. It was found that he never attended these schools.

While at Harvard, the accused won two prestigious writing prizes, the Winthrop Sargent Prize in English and the Hoopes Prize, as well as a research grant. These submissions were also plagiarized. He won a total of $14,000 for these prizes and the grant, and was also awarded financial aid from Harvard totaling $31,000.

As all of this was going on, in January, the accused allegedly stated he was taking the spring semester off from Harvard and applied to McLean Hospital for an internship. He said he was going to work on two scholarly books during this time. The hospital did a background check and found the accused had misrepresented himself in his application and was not given the internship.

In addition, the accused submitted false information in applications of transfer to Yale and Brown universities, stating he was employed at McLean Hospital and had recommendations from hospital employees and his former dean at Harvard.

Volusia Woman Allegedly Involved in Nigerian Money Scam

By now you have probably heard of the Nigerian money scam. These are the scams wherein you are contacted by someone supposedly connected to the Nigerian king, or someone else, in a bid to get you to send them money. The promise is a return of thousands of dollars more than those you send to the Nigerians. The contact comes through email or through a telephone call.

These are called 419, or 4-1-9, scams internationally and are named after the section of the Nigerian penal code which addresses these types of scams. They are part of the Advance Fee Fraud (AFF) schemes.

The Volusia County Sheriff's office has reported that a DeBary woman allegedly orchestrated one of these schemes, in which she collected $25,000. She is currently being held on $50,000 bail on charges of running an organized scheme to defraud. The 44-year-old woman was arrested in January for allegedly committing the same kind of fraud. She was warned by authorities who believed she may not have known that she was participating in an illegal activity.

According to police, the woman applied for a job as a payroll or accounts-receivable clerk, and someone in Nigeria said she was hired. The accused was then told to buy a computer check-writing program. She was then given information compiled by the supposed Nigerian employer that listed other job applicants. The accused then allegedly printed checks using the information and the checks were sent out to people and told the money was for scholarships, rebates, or for legitimate work.

When the checks were deposited, the money was sent back to the accused via Western Union. The victims of the fraud were told to keep a couple hundred dollars. Authorities say about 15 people deposited between $1000 and $2000. When the banks finally told the people the checks were worthless, they had already lost hundreds of dollars.

Investigators claim the accused mailed out over a thousand fraudulent checks last year after she had been told it was a scam.

Florida Gym Teacher Caught Stealing from Students

A Citra, Florida gym teacher vehemently denied stealing money from high school students’ lockers right up until the point he was shown the video of him doing what he had been doing for years, apparently--stealing cash from his students. The teens at the school, fed up with having money taken from their lockers, took action by putting a camera phone into an empty locker positioned in such a way that the teacher could be caught on video rifling through lockers looking for cash.

The physical education teacher, 49-year-old Steven Simmons, who taught at North Marion High School, has resigned, and the kid who caught him is considered a hero amongst his friends; Unfortunately, however, this "hero" could actually be in trouble for bringing a camera phone to school and placing it in the locker room, which, for obvious reasons, is against school rules. The charges Mr. Simmons facing are criminal, however, and the student just broke a school rule about having phones inside the building. No jail time is possible for the kid. Jail time is definitely possible for the teacher.

Basketball Coach Quits after DUI Charge

In a perfect example of what can happen when you are charged with driving under the influence, the newly appointed basketball coach at Hofstra University has quit after only being on the job for one month after being arrested and charged with a DUI. Although he officially quit, the spokesman for Hofstra said, "The university accepted the resignation in the best interests of the university and of the men's basketball program." He was suspended indefinitely after the arrest.

The 49-year-old was a former coach at Iona and Providence. He signed a five year contract worth $3 million, and spent the last two seasons as a commentator on ESPN.

Nassau County, New York police say the coach was arrested Friday, April 30, when he was found asleep behind the wheel of his Lexus at a green light with his foot on the brake. He was taken into custody and given a sobriety test.

Losing a high-profile, multi-million dollar job is bad, but losing it because you made the mistake of drinking and driving may be worse. While there can be no doubt that this coach will have an experienced defense attorney, since he pleaded not guilty, he has suffered the loss of his job, the embarrassment of many people knowing about it, and the shame of what his neighbors will think of him.

Sometimes the public guilt can be worse than the offense.
